Privacy Conditions

I. Basic provisions

1. By the controller of personal data under Art. 2016/679 of the European Parliament and of the Council on the protection of individuals with regard to the processing of personal data and on the free movement of such data (hereinafter: "GDPR") is Jiří Hnilička, ID: 135 07 851, established in Kozlov 39, Střelské Hoštice (hereinafter referred to as: "caretaker").

3. Personal data means all information about an identified or identifiable natural person; an identifiable natural person is a natural person who can be directly or indirectly identified, in particular by reference to a specific identifier such as a name, identification number, location data, network identifier or one or more specific elements of that natural person's physical, physiological, genetic, psychological, economic, cultural or social identity.

4. The administrator did not appoint a privacy officer. 

II. Sources and categories of personal data processed

1. The Administrator processes personal data that you have provided or personal data that the Administrator has obtained by fulfilling your order.

2. The administrator processes your identification and contact details and data necessary for the performance of the contract.

III. Legal reason and purpose of personal data processing

1. The legal reason for processing personal data is

  • performance of the contract between you and the administrator according to Art. 6, par. 1 (b) GDPR,
  • the legitimate interest of the administrator in providing direct marketing (in particular for sending commercial communications and newsletters) under Art. 6, par. 1 (f) GDPR,
  • your consent to processing for the purpose of providing direct marketing (especially for sending commercial communications and newsletters) in accordance with Art. 6, par. 1 (a) GDPR in conjunction with § 7 (b) 2 of Law No. 480/2004 Coll., on certain information society services in the absence of an order for goods or services.

2. The purpose of processing personal data is

  • the execution of your order and the exercise of the rights and obligations arising from the contractual relationship between you and the Administrator; the order requires the personal data required for the successful execution of the order (name and address, contact), the provision of personal data is a necessary requirement for the conclusion and performance of the contract, without the provision of personal data it is not possible to conclude or fulfil the contract by the Administrator

3. There is no automatic individual decision-making by the administrator within the meaning of Art. 22 GDPR. You have given your express consent to such processing.

IV. Retention period

1. Administrator stores personal data for as long as is necessary to exercise the rights and obligations arising from the contractual relationship between you and the trustee and to assert the rights arising from these contractual relations (for 15 years from the termination of the contractual relationship).  

2. After the period of storage of personal data, the controller deletes the personal data.

V. Personal data recipients (administrator subcontractors)

1. Recipients of personal data are persons 

  • participating in the supply of goods/services/making of payments under contract,
  • providing services for the operation of an e-shop (Dům umění Jiří and Kateřina Hniličkovi) and other services in connection with the operation of an e-shop,
  • providing marketing services.

2. The controller does not intend to transfer personal data to a third country (a non-EU country) or an international organisation. 

VI. Your rights

1. Under the conditions set out in GDPR you have

  • the right of access to his personal data under Art. 15 GDPR,
  • the right to rectify personal data under Art. 16 GDPR, or limitation of processing under Art. 18 GDPR.
  • the right to delete personal data under Art. 17 GDPR.
  • the right to object to processing under Art. 21 GDPR and
  • the right to data portability under Art. 20 GDPR.
  • right to withdraw consent to the processing in writing or electronically at the address or email of the controller referred to in Art. III of these conditions.

2. You also have the right to lodge a complaint with the Office for Personal Data Protection if you believe that your right to protection of personal data has been violated.

VII. Privacy Terms

1. The controller declares that it has taken all appropriate technical and organisational measures to safeguard personal data.

2. The administrator has taken technical measures to safeguard data storage and paper-based personal data storage, in particular passwords, antivirus, data storage.

3. The Administrator declares that only persons authorised by him have access to personal data.

VIII. Final provisions

1. By submitting your order from the online order form, you confirm that you are aware of the Privacy Terms and that you accept them in their entirety.

2. You agree to these terms and conditions by ticking consent via the Internet Form. By ticking consent, you confirm that you are aware of the Privacy Terms and Conditions and that you accept them in their entirety.

3. The administrator is entitled to amend these terms and conditions. It will publish a new version of the Privacy Terms on its website, while sending you a new version of these Terms and Conditions your email address, which you provided to the Administrator.

These terms and conditions take effect on 25.5.2018.
